Judge Halts Criminal Case, Invoking Amnesty Law

In a disappointing–but not entirely surprising–development today, a Brazilian judge barred federal prosecutors from moving forward with criminal charges against Colonel Sebastião Curió de Moura. Judge João Matos justified his ruling by invoking the 1979 Amnesty Law, which pardons those accused of political or “connected” crimes. Federal prosecutors had argued that the Law did not apply to kidnappings and the hiding of bodies, crimes which are considered ongoing until the bodies are located. They have since announced that they will appeal Judge Matos’ ruling.

    si hay una ley de amnistía no corresponde ningún procesamiento, pues ello significa que el JUEZ prevaricaría, esto es, el delito más grave que puede cometer un JUEZ.
    La prevaricación se da en tres casos. PRIMERO si el Juez seduce a una procesada; SEGUNDO, si recibe dinero de una de las partes; TERCERO, si no aplica la ley a sabiendas.
